Outrageous verdict

A chemical engineer working in Berkeley, California, discovered that a colleague, David Xu, had allegedly been poisoning her food and drinking water for a year and a half. After the case came to light, he admitted to one felony poisoning charge as part of a plea deal, but the sentence he received drew sharp criticism.

The ordeal began when the engineer, Rong Yuan, suffered for an extended period from bouts of illness, nausea and vomiting. She noticed unusual tastes and smells in the food and water she left at work, but initially did not know what was behind the symptoms.

Eventually she suspected someone was tampering with her food and drink. She installed a hidden camera in her office, and the footage showed Xu handling her water bottle. Laboratory tests confirmed that the water contained cadmium, a toxic metal that can cause serious health damage.

According to reports, Yuan's parents also suffered symptoms after drinking water from a bottle she brought home, and tests found high levels of the metal in their systems.

Xu was arrested and initially charged with serious offenses, including attempted murder and poisoning. But under a plea agreement, the more serious charges were dropped and he admitted to one felony poisoning count.

The court sentenced him to two years' probation, crediting him with one day already served as part of the sentence calculation. In addition, he was ordered to pay Yuan compensation of $7,058, a sum significantly lower than the nearly half a million dollars she had requested.

Now, having completed his probation, Xu is asking the court to expunge his conviction. Yuan opposes the move, and according to reports she fears that expunging the conviction will make it harder for future employers to learn about his past.
