Knesset Rejects Supreme Court's Demand for New Comptroller Vote, Deepening Constitutional Crisis

In a dramatic constitutional standoff, Knesset Speaker Amir Ohana formally rejected the Supreme Court's proposal to nullify the election of State Comptroller Michael Rabilo and conduct a fresh vote. "The Knesset has already spoken," Ohana declared in an official response submitted to the court Sunday, setting the stage for an unprecedented clash between Israel's legislative and judicial branches.

The defiant response came after Deputy President Noam Sohlberg proposed an extraordinary settlement over the weekend: the Knesset would re-run the entire comptroller selection process to eliminate what justices termed an "unwanted cloud" hanging over the controversial election. The court had given the Knesset until Sunday to respond to the proposal, warning it intended to issue a conditional order invalidating the vote due to severe violations of ballot secrecy.

The Court's Unprecedented Intervention

During Thursday's hearing, Justice Sohlberg delivered a pointed message to state and Knesset representatives, proposing what he characterized as a procedural remedy that would avoid direct judicial interference in legislative decisions. "We are proposing a procedural relief that does not interfere with the Knesset's discretion — do it again. Whatever you decide is fine, just in a clean and proper process," Sohlberg stated from the bench.

The judicial panel signaled its intention to issue a conditional order specifically addressing the secrecy violations, not the separate allegations of conflict of interest involving Rabilo's past professional ties to Prime Minister Benjamin Netanyahu. "Right now there is an unwanted cloud, some of the votes are problematic," Sohlberg warned. "Knesset members acted contrary to the instructions of the Knesset legal adviser, creating a new rule that allows photographing."

According to petitions filed by the Movement for Quality Government, the Israel Bar Association, opposition parties Yesh Atid and Blue and White, and retired Supreme Court Justice Yosef Elron, coalition lawmakers systematically violated ballot secrecy during the second round of voting. The petitioners presented evidence that coalition members photographed their ballots behind voting screens to prove to party monitors they had voted for Rabilo as instructed.

Rabilo Defends Election Legitimacy

In a preliminary response filed with the court in recent days, Rabilo forcefully rejected all allegations challenging the legitimacy of his election. The comptroller-designate emphasized his deep sense of responsibility and complete commitment to serving all Israeli citizens, categorically dismissing any suggestion of political dependence or conflict of interest.

Rabilo's legal team argued that the election process was conducted in accordance with Knesset procedures and that attempts to portray him as politically compromised lack foundation. The response comes as the newly elected comptroller prepares to assume one of Israel's most sensitive oversight positions, responsible for auditing government ministries, the military, and state-owned enterprises.

With the Knesset's categorical rejection of the court's settlement proposal, the constitutional showdown now moves to the next phase of litigation. The Supreme Court is expected to proceed with formal deliberations on the petitions challenging Rabilo's election, potentially setting up a landmark ruling on the limits of judicial review over Knesset internal procedures.
