One Year for a Life? Justice Under Fire as Killer of Elderly Jewish Protester Avoids Hate Crime Charges

A controversial plea deal for Loay Alnaji, the man who struck and killed 69-year-old Paul Kessler with a megaphone, has sparked national outrage. As Alnaji faces as little as one year in prison, critics question why prosecutors bypassed hate crime charges that were applied in similar high-profile assaults.

Paul Kessler, a 69 year old Jewish man, was slammed over the head with a megaphone while attending a demonstration between pro-Israel and pro-Hamas supporters.

As the legal process nears its end, the tragedy has shifted from a street-side confrontation to a courtroom controversy. With a plea deal now on the table that could see his killer serve as little as a year in prison, the case is raising searing questions about the nature of justice, the threshold for hate crime enhancements, and whether the law is applied equitably when the victim is a 69-year-old man holding an Israeli flag.

On May 9, 2026 Jihad Watch reported "In November 2023, in a suburb of Los Angeles, a few weeks after the Hamas attack in Israel, there were dueling demonstrations, with some demonstrators denouncing Hamas and others supporting the Hamas attack on October 7. At one point, a Palestinian in the crowd denouncing Israel and praising Hamas, Loay Abdel Fattah Alnaji, bashed a megaphone on the head of a 69-year-old Jewish man, Paul Kessler, who was demonstrating for Israel. The elderly Kessler fell backward, hitting his head on the sidewalk, and later died of his injuries. The man responsible for his death was charged with involuntary manslaughter. Now a plea deal has been reached, and both Jewish groups, and the prosecutors, have expressed their outrage at what amounts to a slap on the wrist..."

Just weeks after the October 7 Hamas terrorist attack in Israel, an elderly Jewish man was killed during a pro-Palestinian protest in California. Now, Loay Abdel Fattah Alnaji, 53, the man who struck Paul Kessler, 69, may serve as little as a year or even avoid jail time.

On November 7, 2023 the Gateway Pundit reported about the murder of Paul Kessler by a pro-Palestinian protestor in LA "65-Year-Old Jewish Man Dead After Pro-Palestine Protestor Hit Him in the Head with Megaphone During Rally (VIDEO)"

On November 16, 2023 the Gateway Pundit reported " California police have made an arrest in the death of Jewish man Paul Kessler, who was killed during a protest last Sunday in California. Fox News reported Thursday that 50-year-old Ventura County Community College professor Loay Abdelfattah Alnaji was arrested. He has been charged with involuntary manslaughter and his bail has been set at $1,000,000.

"...Jim Hoft previously reported that Kessler was involved in a heated altercation that broke out between him and a pro-Hamas protester in Ventura County. The protester allegedly struck Mr. Kessler in the head with a megaphone, causing him to fall to the ground with a severe head injury. Despite the best efforts by the medical professionals, Mr. Kessler died due to his injuries on Monday. His death was ruled a homicide...

"Alnaji is married to Palestinian economics professor Nada Al Hammouri... Alnaji has openly supported and admired the Palestinian terrorists trying to destroy Israel. According to the Daily Mail, he posted multiple messages in Arabic on his Facebook page singing their praises..."

On November 20, 2023 The Philadelphia Jewish Exponent reported "After a suspect was arrested and charged with involuntary manslaughter and battery in the death of a pro-Israel protester near Los Angeles earlier this month, Ventura County District Attorney Erik Nasarenko said that his office has “not ruled out a hate crime” in the case. But he added that at present, based on what the police know, the death does not appear to be a hate crime.

“Simply put, looking at the statements as well as the words that accompany this act, we cannot at this time meet the elements of a hate crime,” he said at a Friday morning press conference. “But nevertheless, we will continue to explore and investigate that offense as well as that special allegation.”

Others were charged with hate crimes for simmilar offences. Why wasn't the murderer of Paul Kessler charged with hate crimes?

On December 5, 2023 the NY TImes reported "Man Charged With Hate Crime in Times Square Assault on Israeli Tourist...

"While following a group through the Times Square area, the attacker used a Bluetooth speaker to play what he said was “Hamas music.”

" A Queens man was charged on Tuesday with several hate crime counts in an October attack on an Israeli tourist in Times Square who was punched in the head by an assailant invoking Hamas, the Manhattan district attorney said.

" The hate crime charges against the man, Yehia Amin, were among the latest to arise from a spate of bias incidents in New York City in the past two months amid the war between Hamas and Israel.

"In the case of Mr. Amin, 28, prosecutors said he had followed the tourist and four friends, all five wearing skullcaps, as they visited Times Square.

"Mr. Amin, prosecutors said, played what he told the men was “Hamas music” through a Bluetooth speaker while following them for several blocks and making antisemitic comments that included “Hamas should kill more of you” and “All Jews should die.”

"After tailing the men for 10 minutes, prosecutors said, Mr. Amin sprinted up behind one of them, a 23-year-old, and punched him in the back of the head before running off.

" The police caught him a short time after he fled, and he continued to shout antisemitic remarks while being arrested, prosecutors said.

If Yehia Amin was charged with hate crimes, why wasn't Paul Kessler's murderer?
