IDF Disciplinary Hearing Canceled After Legal Challenge

A company commander in the IDF's Rotem Battalion has reversed his decision to hold disciplinary proceedings against soldiers who did not refuse orders, following questions about the legality of such action.

The development comes after members of an engineering squad in the battalion were tried yesterday for refusing to travel with a female paramedic in an armored personnel carrier. Those soldiers received sentences of five to ten days in military detention.

After that hearing, other members of the same squad, those who had not refused the order, were summoned to appear before the company commander for their own disciplinary trial. The soldiers protested that they could not be tried for not refusing orders, arguing they had committed no offense. This morning, commanders informed the soldiers that the trial had been canceled and would be replaced with a discussion about the incident.

The incident occurred over the weekend when a force from Rotem Battalion, part of the Givati Brigade and composed of religious yeshiva students, was preparing for an operational mission in the Gaza Strip. The assignment required the force to conduct an operational patrol in an armored personnel carrier.

When the soldiers learned that a female paramedic would be joining the force, three soldiers refused to board the vehicle with her, and five additional soldiers also refused.

The refusal led to the cancellation of the operational activity. Following the incident, it was decided that the soldiers would face disciplinary proceedings. The remainder of the squad was confined to base until a resolution is reached.
