An Australian court has ruled that a viral video showing a Sydney nurse and her brother allegedly making antisemitic threats against Israeli clients cannot be used as evidence.

The siblings, who worked at Bankstown Hospital, were suspended last year following global outrage from Jewish communities. Despite facing criminal charges for intimidation and harassment, both have pleaded not guilty.

Evidence Deemed Illegal

Judge Michael McHugh excluded the footage because it was recorded without the defendant's consent, violating New South Wales privacy laws.The Defense attorneys noted that without this central piece of evidence, the prosecution’s case is severely weakened. Authorities must now re-evaluate whether they have enough remaining evidence to proceed with the trial later this year.

Community Fears Rise

The ruling has intensified anxieties within Australia’s Jewish community, which is already facing a rise in antisemitism, including a recent synagogue arson.

The prospect of the workers escaping conviction on a technicality fuels a growing global fear that healthcare professionals and service providers are increasingly showing overt hostility toward Jewish and Israeli clients.
