Australian Woman Convicted in 'Death Cap Mushroom' Poisoning Case Appeals Life Sentence

A three-judge panel at Melbourne's Court of Appeal has begun hearing arguments in the case of Erin Patterson, the 51-year-old Australian woman convicted in 2025 of murdering three people and attempting to murder a fourth by serving them a meal laced with deadly mushrooms.

Patterson was sentenced to life imprisonment with eligibility for parole after 33 years. The appeal proceedings, expected to last two days, are running concurrently with a separate appeal filed by prosecutors who argue her sentence is too lenient.

Appearing via video link from a maximum-security Melbourne prison, Patterson is watching as her defense team argues that "serious miscarriage of justice" occurred during her trial due to the judge's erroneous rulings on admissibility of evidence, including Facebook messages and cell tower location data.

Her lawyers contend that procedural errors "fundamentally undermined the integrity of the verdicts" and that her cross-examination was "unfair and oppressive." The prosecution, meanwhile, maintains that the minimum 33-year term before parole eligibility is "manifestly inadequate" and that the sentencing judge erred in his considerations.

Patterson was convicted of murdering her former husband's parents, Don and Gail Patterson, and his aunt, Heather Wilkinson, by serving them beef Wellington containing death cap mushrooms. She was also convicted of attempting to murder Ian Wilkinson, a local pastor who survived after prolonged hospitalization.
