Zelka murder suspect admits stabbing

Defendant confesses he came armed to the scene and stabbed the victim, but defence argues for downgrade from murder-with-indifference to negligent homicide | Lod District Court hearing

A significant development took place Sunday in the Lod District Court in the case of the murder of Yeman Binyamin Zelka z"l, who was killed on the eve of Independence Day in Petach Tikva. The main defendant admitted before the judges that he was armed with a knife that night, came to the scene intending to take part in a brawl, and stabbed the victim.

However, the defendant's lawyer explained that his client did not intend to cause Zelka's death. On that basis, the defence is arguing that the defendant should be acquitted of the charge of murder-with-indifference filed against him in the indictment, and convicted (at most) of negligent homicide.

The Central District Prosecutor's Office filed indictments in early May against 16 youths suspected of involvement in the murder. The main suspect, a 15-year-old boy, was charged with murder-with-indifference after he was filmed stabbing Zelka z"l, with the stab wound hitting a major artery and causing significant blood loss that led to the death of the 21-year-old. Fifteen other youths were charged with aggravated assault with intent for their involvement in the violent incident.

The legal difference between the two offences is highly significant. Murder-with-indifference is defined as a situation in which the defendant saw the possibility that the person would die but did not care, and the punishment can reach life imprisonment. By contrast, negligent homicide refers to a situation in which the defendant did not foresee the fatal outcome, and the maximum sentence is 12 years' imprisonment.

The Zelka family reacted with fury to the indictments already at the time they were filed, claiming that "the prosecution chose the side of the criminals. Instead of understanding the gravity of the hour and filing indictments with unprecedented charges that would prevent the next murder, they chose to go easy and let Yemanu's killers off cheap".

During the investigation, findings emerged pointing to advanced planning. Investigators from the Sharon youth crime unit in the Central District found footage showing that shortly after the murder the suspects changed clothes, with some arriving at the scene with an extra layer of clothing in advance. In addition, content was collected from social media groups in which messages were heard calling to discard clothing and flee the scene.

The shocking case sparked a broad public debate on the wave of violence among youth. President Yitzchak Herzog hosted the Zelka family at the President's Residence on the eve of Tisha B'Av, and said that "a society is destroyed from within by hatred and violence". The family members continue their struggle for severe punishment of those involved in the murder.

The court is expected to continue hearing the defence position and the prosecution's arguments in upcoming sessions, with the decision on the classification of the offence set to have a material impact on the defendant's fate.
