Royal commentator Ian Pelham Turner told Fox News Digital the timing of this renewed legal saga could prove especially damaging for Prince Harry, who has reportedly made private overtures to the royal household, including sharing his official engagements with the Palace.

British royal expert Hilary Fordwich echoed the sentiment, noting the royal family’s enduring commitment to Queen Elizabeth II’s maxim: never complain, never explain. “There is nothing good about this for Meghan Markle,” Fordwich said. “Whether the allegations are true or not, the optics alone are harmful.”

“A Case Given a Death Sentence”

Samantha Markle’s lawyer, Peter Ticktin, confirmed to Fox News Digital that the appeal seeks to overturn the original dismissal, a decision made by a district court judge in 2024. “We are hoping and somewhat expecting that the panel of three judges on the 11th Circuit Court of Appeals will see the error by the lower court and reverse the dismissal,” said Ticktin.

Legal analyst Jonna Spilbor described the situation as a rare but not impossible scenario. “The case may die another day,” she said. “But that won’t be determined until after the hearing.”

Meghan is not expected to attend the proceedings.

At the heart of Samantha Markle’s lawsuit is Meghan’s characterization of her childhood, including her widely publicized remark to Oprah that she “grew up as an only child.” The court previously found the comment to be a protected opinion rather than a verifiable fact, but Samantha’s legal team continues to argue the statement damaged her reputation.

Samantha also alleged that Meghan’s implication she only reclaimed the “Markle” surname after Harry entered the picture was defamatory. Harry’s memoir Spare, which painted an intimate and often critical portrait of royal life, did little to mend ties with the monarchy. Relations with his brother, Prince William, remain icy, according to multiple sources.

Yet recent reports, including one from The Mail on Sunday, suggest Harry may be seeking a new chapter. His aides reportedly met privately with King Charles III’s communications team last month. The King, who was diagnosed with cancer in early 2024, has not made any public comment on a potential reconciliation.

While Harry navigates royal diplomacy, Meghan has been focused on her new ventures, including her lifestyle brand As Ever and the Netflix series With Love, Meghan. But according to branding expert Doug Eldridge, personal controversies like the lawsuit continue to pose reputational risks.

Despite her ongoing projects, Meghan has kept silent on the renewed legal challenge. A spokesperson for the Duchess told Fox News Digital there would be no comment.
